I am currently a law student looking to learn about intellectual property and more specific, domain name law.

1) Let's say a person sues another person for childish things like saying the "F" word in email, isn't this a "misuse" of the court system? Please show me cases in where the plaintiff misuses the court system for "childish acts", and the judge award the victory to the respondent.

2) Person A is in USA. Person B is in Japan. Person A sues Person B for dispute over quality of service. Let's say person A sues person B in the court system of USA, and person A wins because person B never show up in court. Is this even a valid sounding case? Can the judgement from USA carries into Japan, and person B be liable for the judgement? But person B lives in Japan. Isn't person B protected by the laws of Japan, and whatever judgement held in USA will not be affected to him? Cause he is a japanese citizen?

Ok here is the problem , i was transferring my domain from Namescout to Name.com and the domain was expired 2-3 days maybe , i initiated the transfer , entered the auth code and got the email from Name.com and authorized the transfer and today i type in Eluu.com and i see the Pool.com page ? what happened ?

A while back I sourced a domain for a decent price and negotiated its purchase from the previous owner. Another party put up the funds for this purchase and we agreed to split the ownership of this domain 50-50.

Now we want to use this domain to build a business that will be split in a different manner. First we want to establish 50-50 ownership and valuation of this domain at an agreed upon amount prior to forming this new venture, so if this new company would ever sell, the domain would be worth $xx,xxx or 10% of the company sale value, whichever is higher.

Have any of you ever drafted such an agreement? I can certainly approach one of the legal eagles here or elsewhere, I just wanted to see if anyone had any input that I might not have thought about already.

Let me explain;

Checked for availability at godaddy search and it came back as available. Went through the whole checkout process (paid with credit card) and the domain still isn't in my account.

So I go and check the whois and now all of a sudden it isn't available (already reg'd) and it shows that it has been continuously reg'd for the last 10 years!

What the hell is going on here? Anyone know?

I won a UDRP a couple of years back.
A lawyer representing this (very large) company contacted me (actually my secretary) and said they want to buy the domain.
What should I do?
I am thinking of having my lawyer call him. But what should he say?
I am thinking of asking for an offer in writing.

The funny thing is that he is not working for the firm that compiled the UDRP complaint. :)

there is a domain for sale with traffic. when i Google it an old drug propduct that was TM pop's up. It does not seem like the company is around - does anyone see any issues with owning and parking such a name with drug related products under it?

Let's say you're thinking about registering a two word .com name. There will be a hyphen between the words. The non-hyphenated name is trademarked by a company but the trademark is not related to what you'd use it for; the trademark is for an unrelated product in another industry.

With this said, would you still be walking into dangerous territory by registering the domain?
