    Thumbs down Nissan.com - The Battle still raging 14 years later

    Nissan.com was regged back in 1994 by Mr.Nissan, he ran a couple of associated businesses with it, he still does.
    Nissan decided they wanted and they have bullied this guy for 10 years.

    I belive that Nissan Motors is the Posterboy for Attempted Reverse Domain Name Highjackers. In fact, because of their sickening pursuit of the domain, I would NEVER buy a Nissan vehicle.

    After reading all the legalese, I'd say it's best if they resolve it with pistols at 11 paces, at 2am behind the old cematary.

    If Mr. Nissan would even consider selling the domain, I'm sure the price NOW would be many times higher than it would have been if they wanted to negotiate in good faith, which is how the name was registered.

    So, it seems what you're saying is that Nissan's lawyers were not looking out for Nissan, but their own motivations... which is to litigate and to milk Nissan motors, which wouldn't surprise me. And if that's the case, I wonder if Nissan Motors could sue their lawyers for incompetience.

    JANUARY - 2008, Motion For Attorneys’ Fees.
    Nissan Motor has been unrelenting in its lawsuit against us and despite that they lost; they subsequently filed a motion asking the court to award them millions of dollars in attorneys’ fees.
    C'mmon, you guys lost, now you want lawyers fees!
    FEBRUARY - 2008, Ruling on Attorneys’ Fees and Final Judgment.
    The court has issued a Ruling (PDF) addressing these remaining issues:
    1. Nissan Motor is NOT entitled to attorneys’ fees.
    2. Nissan Computer is entitled to cost under rule 68.
    The court ordered NMC to pay $58,000 as cost under rule 68, this is less then 2% of what the cost was to defend this case.
    What an expensive legal ordeal!
    You would think this case is over….. but it really isn’t.

    MARCH - 2008 Nissan Motor’s trademark registration.
    Nissan Motor is attempting to obtain a Federal Trademark Registration for computers and computer peripherals among other classes of goods and services. We feel that Nissan Motor, in this action, is staging a future case against us in the computer and peripherals market.
    We are left with no other course of action but to oppose this registration and filed a 90 days extension with the USPTO (United States Patent and Trademark Office), which give us until July 16th 2008 to file our opposition.
    C'mon guys, who you trying to fool!
    Public awareness of this unacceptable corporate behavior is crucial to eradicating it and we are asking you to take a stand and make a difference on this issue. Your collective voice is more compelling than the lobbying power of corporate giants and it is a voice that cannot be ignored.
    Together we can make a difference and help keep our freedom intact, for us, for our children, and for our grandchildren.

    No - If Mr. Nissan was associated with a domain forum, I think Nissan Motors and their lawyers would try to spin it against him.

    All the publicity about this case should simply serve as a warning to anyone doing business with websites on domains that are essential to their businesses. This could happen to YOU!

    I also wouldn't buy a Nissan because of this. Hats off to the guy for standing up for what's right, and not caving in to corporate bullies.

    He deserves a medal IMO.
