Country: | Snowe bill, fear influences perception ? Will the Snowe bill overturn UDRP decision of SUPERVALU’s frivolous claims to own the generic domain "shoppers.com" ? Not likely Article quote: "Reason prevailed" Those of us domainers who have registered or acquired domains with infringing intent are and should be vulnerable. Infringing intent is key. As with those of us domainers that registered or acquired generic domains without intent to infringe, reason will prevail whenever frivolous legal actions are initiated regarding true generic domain names as shown in this latest case and the many other previous cases the UDRP has ruled this way. One wonders if the fear that the Snowe bill induces over some domainers may have merit. Again, intent is key of whether or not claims are justified or frivolous.
Rest easy,,,,,,,,,,,,,,,,,,,,,,,,,,, to all of us honest domainers with no intent to infringe. See Article about SUPERVALU’s frivolous/false claims of trademark infringement. http://domainnamewire.com/2008/04/10/buyer-of-166000-shopperscom-can-keep-domain-name/
Also, see article of failed attemps to capture the Ace.com domain through frivolous claims of intent to infringe. http://domainnamewire.com/2008/04/11...s-arbitration/

Country: | Oh dear.
I'm curious, is the Snowe Bill going to affect citizens of the United States or will its repercussions be felt the world over?

Country: | Well then, if the worst comes to the worst, then as a community we cease to exist, right?
Or is it another one of the "Survival of the fittest" things..where in the bigger fish swallow the little ones, and continue to buy/sell domains and the little ones sit and watch from the sidelines..?

In the US we have this great thing called "imminent domain" which means the government is allowd to take your land from you if the development is going to benefit the community, even allowing private contractors this power. They will only pay you pennies on the dollar of what you can actually get for the property.

Country: | Oh!
Yeah, I get what you mean...My dad tried to sue some contractor (...in vain) because he wanted to construct a road that CROSSED our plot.
...With the result, we now have two chunks of land either side of a busy road with the same address

Anyone remember the contractor who proved to the state that he could bring in a large amount of tax revenue with a large plot of land? The land was where on of the chief justices who made the ruling lived. I don't think the contractor got it (but that wasn't the point).

But to add to that..I feel, its no longer possible to exist in isolation...Agreed India still has a long way to go, but hey, imagine if any country just went under "quarantine" or something - and broke all contact with other nations.
It'd be chaotic.
...so somewhere or rather, it will make a difference to the world if such a Bill is passed.

Country: | Man, that thing with SupaValu burns me up... what a bunch of bastards! "Oh, it's too expensive, let's just sue for it instead!"
Simon: Quite right... except India's Department of Treasury doesn't have the power to seize and freeze all of your assets, regardless of which country you may happen to be a national of... For some odd reasons the United States' D.o.T. does... |
