I'm not 100% sure that it's THAT clear-cut, as Spike actually SETTLED (out of court) with Spike TV. My take is that it depends on your POWER (a.k.a. resources).

right, the loser can appeal the decision, but I highly doubt it will be overturned
When it comes to the legal battle ground (court, instead of WIPO arbitration), the rules of the game is *a bit* different. Again, your resources matter much. But since we have Spike Lee (the more "powerful" party) as the winner in this case, I too don't see much chance of an overturn.
