Internet’s Founding Architects: Latest U.S. Senate Effort To Block Online Pirates Will Instigate Internet Chaos

By: Sarah Lai Stirland, Assistant Managing Editor, BroadbandBreakfast.com
SAN FRANCISCO, November 18th, 2010 — The U.S. Senate’s latest battle plan against intellectual property piracy online could gain traction and be approved by the body’s Judiciary Committee Thursday, but a large group of the Internet’s founding architects are warning that the plan’s technical approach would wreak havoc and destabilize the global network.

The group includes many of the pioneering engineers who designed the fundamental protocols and standards that gave birth to the internet and the web, and which makes up its DNA today.

MIT Professor David P. Reed is one of the 89 internet pioneers who told the U.S. Senate Judiciary Committee Tuesday that a Hollywood-championed bill targeting online pirates is fatally flawed.

The committee could vote to approve the legislation on Thursday. Nov 18th, 2010

So far there’s been no hearing to air the concerns voiced by the internet community.

Our economy isn't bad enough so we're going to cripple every telco, host, and backbone provider still making a profit? Brilliant! No wonder we're not #1 in anything but debt any more.

So what timeline are we looking at, and how is it set to proceed from here?

    Very well put...DC20

Not sure, but I think it will go to the "Senate" for debate and then a possible vote, it all now could happen pretty fast.

Just in case, read this related article, because it really lays out how it could effect our "DNS" & IP system.

Which will/could effect all of us domain & website owners to some degree...a little or a lot ( sounds like a "lot")

    Hi,

    **Update**

    ____

U.S. Senator Ron Wyden vowed yesterday to take steps to block the controversial bill that would let the government effectively block access from the U.S. to sites involved in copyright infringement.

The Combating Online Infringements And Counterfeits Act (COICA) would let the Attorney General petition the courts to blacklist any website on which copyright infringement was a ‘central’ activity. Domain servers operating in the U.S. would be required to stop handling requests for sites on the blacklist.

COICA has broad support from both parties, and breezed through the Senate Judiciary Committee 19-0.

But with just a few days left in the legislative session, one Senator can put up enough procedure hurdles to prevent a vote before 2011, at which point the bill will have to be resubmitted.

    A. impossible to do
    B. the US government doesn't control the net, even though most think it does
    C. icaan is the power of the net
    D. wipo is the only place where a domain can be legally taken from a name owner

you want to see how fast the US gov can be ***** slapped on this

if they dare try to take a legitimately used name as wipo clearly defines legitimate use today

    the owner goes to wipo

    guess what

    THEY GET IT BACK

yep, the US gov by treaty must BOW to icaan and wipo

one is INTERNATIONAL in scope (icaan/wipo) and the other is national in scope

granted copyrights and trademarks are essential in domain use

but wipo already handles the disputes

you follow wipo use rules on any domain, you got no problem

now if you are running counterfeit goods from china and famous trademarked tld's

yeah, US gov can do a pony show and take a domain with a court order

but if the use didn't violate INTERNATIONAL TM LAW controlled by wipo, they would lose any wipo action trying to get the domain back

    so nothing changes

you abuse a TM of someone else, you can lose it now in a US court, so what

TM law is international by TREATY

so any US law is subservient to wipo by TREATY

if you can win in wipo, you will get any name back the US gov tries to take

plus then you sue the US gov in international courts and get huge judgments on them

    LOL

    they sky isn't falling

no national or regional government can tax or legislate the net

    no one OWNS it

ATT just settled a huge class action on the taxes they extorted from wifi cards and iphones

    you can't tax the net

    end of subject

what you can't tax no government can legislate

    LOL

    FREE THE NET

    oh it is free...

This smells like a redux of the Snowe bill - plus "copyright infringement" is so subjective many times.

And now for something completely different....from the BBC:

    http://www.bbc.co.uk/news/technology-11863288

With names like that, it's no wonder.....until you get to the Torrent site. Interesting the agency they are doing it under, I would have thought it would have fallen under different jurisdiction.

...be sure to check out the related articles.

...I guess now I have to go all the way to Wally mart to buy that Chinese Louis Vuitton knockoff now.
