    I plan on developing it to show trailers as well (on individual posts).

    I was about to invest in a movie trailer website. What turned me away from the idea was the legality of showing such trailers (IP of the movie companies).

    In my research, I found a court case from a few years back in which somebody sliced up pieces of movies and made them into a homemade trailer. He obviously lost the case, but the judge's comments are what did it for me:

    The judge found Video Pipeline liable for copyright infringement, trade mark violation and unfair competition. Judge Jerome Siandle wrote:
    "Trailers have become more than advertising material for other products; they have become valuable entertainment content in their own right, as web surfers continually frequent the internet to view these on-line commodities prior to movie releases, [...] and such previews increase web site traffic and on-line 'stickiness,' which give web site owners additional time and opportunities to market their services and products."

    I don't really understand. If I embed the official movie release trailer, what's wrong with that?

    Maybe not a good idea for trailers, but it still provides content that the type-in traffic may be looking for and since it's mostly comprised of duplicate content, it won't rank too high but will provide some SE traffic as well.

    What the judge was saying is this:
    A trailer is a way to attract people to a website. A website provides additional marketing opportunities for movie studios. If people go to your site to watch the trailer, they aren't going to the movie studio's site to watch it (or another approved site). This "robs" the movie studio of the additional marketing opportunities that they otherwise would have.

    I know, it's ridiculous. But the movie studios have millions to spend on lawyers and technically they are losing out on additional marketing opportunities so of course they won in court, and would win if they took you to court (also due to precedence).

    Movie trailers are copyrighted works so it is illegal to distribute them without permission.


    Will they come after a small site? I doubt it. But they could, and they would win if they did. And if your site got big you'd definitely be hearing from them.
