Actually, SnapNames gives the prior owner the right to "claim" their cut (10-20% of the auction - I don't know the exact percentage, because they only offered me $9.20 as my cut of the proceeds for one of my domains which was auctioned of).

Maybe Nelson can comment about the actual percentage.

If you are trying to catch CCTLD's dropping it's a different story. I snagged a 1 letter CCTLD on a drop. I also grabbed a .cc domain appraised at 20k on a drop. I agree that catching a dot com expired domain is virtually impossible, if it is worth anything.

Outright Scam

For the most part, all fish in the sea is free until it gets caught. Catch it and it gets a price. Some Salmon, some Tuna.

Domains are just like that. Some get away from the net. Some get caught. Before you get them in the net, they are either free or have a price tag attached.

Net them first. It is all fair. Be a better fisherman.
