Florida, with 7 other states to sue federal govt. over H.C. bill

    http://www.reuters.com/article/idUSN2215987420100322

MIAMI, March 22 (Reuters) - Florida's attorney general will file a lawsuit with nine other state attorneys general opposing the healthcare legislation passed by Congress, a spokeswoman said on Monday.

"The health care reform legislation passed by the U.S. House of Representatives last night clearly
violates the U.S. Constitution and infringes on each state's sovereignty," Florida Attorney General Bill McCollum, a Republican, said in a prepared statement announcing a news conference.

"On behalf of the State of Florida and of the Attorneys General from South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, North Dakota, South Dakota and Alabama if the President signs this bill into law, we will file a lawsuit to protect the rights and the interests of American citizens."

Well, in the interest of American citizens, I think ceasing federal funding for capital improvements to those states' health care facilities, teaching institutions, research centers would be the first step in helping the rest of us move on and start a real recovery.

---------- Post added at 11:45 PM ---------- Previous post was at 11:41 PM ----------

    Oh, and let's not forget...

Those State's Attorney Generals are elected officials as well. Filing expensive and non-winning lawsuits at the expense of the state and the taxpayers when those states can least afford it won't sit well this fall.

My God, all of this non-sense reminds me of the Kenneth Starr witch hunt.

I happen to think its a good idea. The health care bill mandates you have health insurance that will in turn burden the states financially.

This quote from Thomas Jefferson I think sums up what eventually must be done.....

"God forbid we should ever be twenty years without such a rebellion.
The people cannot be all, and always, well informed. The part which is
wrong will be discontented, in proportion to the importance of the facts
they misconceive. If they remain quiet under such misconceptions,
it is lethargy, the forerunner of death to the public liberty. ...
And what country can preserve its liberties, if its rulers are not
warned from time to time, that this people preserve the spirit of
resistance? Let them take arms. The remedy is to set them right as
to the facts, pardon and pacify them. What signify a few lives lost
in a century or two? The tree of liberty must be refreshed from
time to time, with the blood of patriots and tyrants.
    It is its natural manure."

I disagree Greg, The Health Care Bill is NOT a Tax, it's a mandate by the Government that forces the American people to purchase something PRIVATE, If it were PUBLIC, perhaps you can make the argument.

What this Bill does is FORCE everyone to buy Private Health insurance under the threat of fines and imprisonment, It's the first time in history the US Government has ever made such a mandate, A mandate that violates individual liberty.

You cant force somebody to purchase something "Private" that they don't want, and that's what this Bill does.. If we allow it to happen with Health care, it will open a floodgate to other private mandates.

I'm quite confident this will be overturned by the US Supreme Court... And if they don't do it, The Republicans will when they regain control of both houses and voters kick this socialist asshole out of the White House.

Please vote Republican in 2012, America can not sustain another 4 years
of Liberal policies that are fiscally and socially destroying the country.

A bigger crime has been committed to all of us and I have a question...

where were these same AG's in filing lawsuits to recoup funds from the now defunct and now mergered banks, insurance companies, etc to recoup money lost, stolen, and mismanaged by those entities?

We are talking trillions of dollars of state pensions just simply gone away.

And they don't are about that?

Do they (or he/she) care about some entity like Blue Cross/Blue Shield asking for a 39% increase in fees it charges for premiums???

And someone tell me why BC/BS of California is asking for the increase (rhetorical question: I know the answer - but do you know the answer they gave when they responded to the question WHY?)

I find the most comical thing is the GOP's smugness in everyone siding with the party think/speak is a win for them this fall!

If you believe that there was not one person thought that such a bill was worthy of passage but voted NO because that is what the party wants, if you truly believe that then you need to get back to reading Mein Kampf Republicanis and the GOP script for the day.

Because these same people will have to answer the question,

why did you not want my child to be insured?
Why did you not want my college kid to stay under my policy until they graduate and were out on their own?
Why would you allow BC/BS of Cali raise premiums 39%?
Why would you allow BC/BS of any state to drop a sick person?

I will start my own campaign against replacing these AG's for failure to respond to and file appropriate action to recoup monies lost by the scoundrels in Washington and Wall Street, who decided that certain companies were "too big to fail" while allowing sovereign states and the State's pensions to fail, and why they fought to prohibit the healthcare act while holding their hand outstretched to accepts kickbacks and other federal monies.

I would give them the option of going it alone and forfeiting federal funds for any healthcare options in the state, to include forfeiting the payment of Medicare and Medicaid funds to hospitals and doctors.

In other words, if these states claim their rights under the 10th amendment, then so be it...develop, fund, and good luck with your own programs because you are on your own.

That is federal dollars of 14 states that no longer need to be paid. Now the other 36 can get to work on creating a better America and taking care of people.

    F*ck them and their handouts..,

Only if Whoopi Goldberg and Rosie O'Donnell honor their pledge to leave the country if Bush was re-elected.

I'll gladly drive the bus to wherever those three want to go.

    Exactly.

I think people need to go out and read the stories of who this actually helps. Instead of listening to the fear mongering radio talk show personalities with hidden agenda$ and kooky buzz words.

I was touched this morning by reports of sick individuals who had treatable illnesses and now covered by their parent's plan where before coverage & medication was just too expensive.

On the other side of that coin, it's the uninsured who drive up the astronomical costs of medical care and the wait times in emergency rooms.

By the way, vehicle insurance is a requirement in many states just so we all realize that it's not the end of the world.

It is hard for some people to remain factual when they don't even know the facts.

It is very, very easy to find these facts, when certain things take effect, how long or how much it will be, and why.

Plus, I would never see the day when people on this forum willingly admit that they have no health insurance. In the meantime, myself and everyone else that is on someone's or some companies payroll are paying for their healthcare should they get sick or need emergency treatment. That is a fact. It is on my pay stubs. So if I am already paying for someone else's healthcare, or everyone else's healthcare, then just accept the fact that we have been providing healthcare for everyone for decades.

As for illegals getting healthcare - same thing. Anyone showing up at a public hospital or any hospital that gets Medicaid and Medicare dollars MUST provide healthcare to all who enter via Emergency. This also has been going on for decades and George W. Bush extended those benefits prior to leaving office.

Here is another tidbit of information that is fact - ask any doctor or hospital worker in the billing department which, of all the insurers, pays on time month after month after month and the only answer will be Medicare and Medicaid. Yes, that is guaranteed money whether they admit to it or not. Already I am hearing doctors say they will no longer accept medicaid and medicare...well, I hope they are ready to retire because they just cut their own hands off.

Every major hospital in my area,

    High Point Regional
    Moses Cone
    Wake Forest Univeristy Baptist Hospital

has had to FILE SUIT against BLUE CROSS and BLUE SHIELD of NC over non-payment. These are MORE FACTS easily researched on the internet.

Not only did BC/BS not pay, they did not pay from anywhere from 2 - 3 years! And then when the hospitals filed suit and refused to take BC/BS, then BC/BS wanted to re-negotiate their own fees that they set!!! Renegotiate their own fees that they set two, three, four years prior!

This was nothing more than a game they played. They would do this to a hospital one at a time, in the order that I listed, to be sure that someone in the area would take their patients in a crisis. They did this for years. Now how much money was made in trusts by NOT paying the bills? Where were the AG and State Insurance commission then?

Okay, that is NC. Imagine, that is just one area in the state, called the Triad, that BC/BS has done this to.

But this same scenario with insurance companies plays out every day in the US. Without doubt, I am sure these games and tactics have gone one in every state. In the case of High Point, I know that was about 3.5 million owed (perhaps 10 years ago). I forget the figure on Moses Cone. But just a few years ago it was in the area of 11 mil at baptist.

But the only one that pays on time is Medicaid and Medicare. So without those programs every public community hospital would be closed. And I do mean closed because they do not have the cash flow and capital to pay staff and order supplies.

So if you hear your doctor say they will no longer accept Medicaid/Medicare because they are outraged at the new healthcare, do yourself a favor...

find another doctor because in 6 months, he will be out of business.

Bravo! Kudos to you. Clear forward thinking on your part.

    And, did you learn something?

I read it when it was like 1670 pages.

Once you get beyond the legal jargon, it is not that difficult to follow along with.

the problem was is there were so many diifferent plans I had to register close to 300 names to make sure I was covered and with the drop in parking income I just barely was able to do that, however the occasional sale has made me some good income I love domaining

You have clearly illustrated the advantages to taking the time to enter into unknown realms and cherry pick.

Not only does reading such a bill provide you with ideas, but the simple fact that reading is learning firsthand and not listening to the talking heads.

Of course there are exceptions, Those who cant afford it would be subsidized, Those who qualify for Medicare would not have to buy... The point I was trying to get across is the "Mandate", that "everyone" be insured. For those who CAN afford Health Care coverage, this group of Americans will be FORCED to buy Health Care from private insurers OR face fines and imprisonment if they don't comply.

Are you really OK with Government mandating that you buy private anything? If they passed a bill that forced you to buy a new car to save the Auto Industry from going under, would you be OK with that to?

And it's not just mandating the People to buy health insurance, This Bill mandates the States, Forcing States to add tens of thousands of people onto Medicaid, It's a HUGE burden and that's what these lawsuits are about, States DON'T have the money to pay for it. Take a State like California that currently has a $24.3 BILLION dollar budget deficit, Explain to me how their going to pay for it?

And what about mandating businesses to provide Health Care to ALL it's employees? What impact do you think that will have on the unemployment rate?, not to mention inflation.... Take a large company like Caterpillar, they estimate the additional Health Care costs will be over $100 MILLION Dollars in the first year alone, which could result in $100 MILLION Dollars of LESS EMPLOYEES.

2014 is when the most expensive mandates kick in, Very well calculated by the Democrats of course, If it FAILS (and it will) A Republican President will be left holding the bag.

But if the US Supreme Court rules against the mandate as unconstitutional, it wont have to go that far.

But if the US Supreme Court rules against the mandate as unconstitutional, it wont have to go that far.

You have clearly illustrated how well you kiss ass.

    Bravo!
    Raider

your comments begin with" of course there are exceptions"

so, that means that you have now acknowledged the distinction between "whole truth" and partial truth, and how the latter can be used to manipulate behaivor.

you probably also have seen how this whole truth vs partial truth thingy works for your arguments

my position basically is expressing "whole thruths" to the best of my knowledge, without spin.

    saying all that to say

i could appreciate your opinions better, if you could stick to the truth or the facts, and do it if possible, without demeaning others.

    it doesn't help

    imo...

And regarding that CAT letter, one thing that you conveniently omitted was the projected costs includes 40,000 retirees. It addresses CAT everywhere in the US, not Cali alone.

Ok, take the state of California.

Every illegal alien that walks through the door into an Emergency Room
Every citizen that does not have health insurance that walks through the door into an Emergency Room...

Guess what? They are already paid for! Our taxes are already paying for them! At least mine are.

Mandating the states cover these people? That is already Mandated and covered by LAW!

Where was your outrage when Bush extended this benefit.

So here is the solution to Cali woes:

Let those that have health insurance pay 39% more in premiums and deductible to pay for the shortcomings.

Then, come back and tell me how much that has cost the state of California, how many more jobs were lost, and how many more people become uninsured because they can not afford a 39% hike in Premiums (along with a 32% hike in higher education). You want to talk about billions lost? How much do you think an increase in 39% is going to cost those same companies you mention? How much more is it going to cost Cat PER YEAR?

So, at the cost of profits, a company with 30 or more employees MUST provide healthcare? Wow, how horrible. Here's the reality...the cost per person would actually COME DOWN. It is all of those who do work and who do pay taxes that are paying for all of those that CAT does not insure.

Plus, CAT is concerned about taxing their drug subsized benefit that is currently tax exempt. Perhaps that can change as this bill is open to discussion and change.

Plus, lets face it eva...it addresses the issue of the Medicare drug subsidy signed into law by Bush that was NEVER FUNDED to begin with, talking about leaving something for "the other party".

As for CAT lose of profits, losing this and losing that...well, their Top Exec took home over $14 million dollars. Actually, the top 5 execs were compensated over $50mil.
