Yes, that can happen.With so much time, what if the evidence is distorted or tampered?
At some point you have to decide whether you expect the system to be geared toward upholding the Constitution of the United States or "catching bad guys".
Until someone convinces a judge to issue a warrant based on probable cause to conduct a search likely to result in specifically sought evidence of a crime then, no, there's no search.
