I have no choice but to sue them now to recover this money. My question is, how do I go about this, since they are in NYC and I am in California. Do I need a lawyer in NY or can I file suit in California?

What does your contract with them say?
Ordinarily, a contract will specify where, as a condition of the contract, you may bring a suit.
