They say " Concerning unautorized use of the smurf characters"
I have 1 image of what may be perceived as a smurf but it is original work and was sketched for me / painted, so it in no way is an unauthorized use of one of their characters.
"Failing to comply ( in basically handing the domain back ) the matter shall be bought to the attntion of the competent and arbitration autorities to have you cease your infringements of our rights with indemnity"
I have no need for the domain anyway / not using it - should I just give it back to them ?
I also received the letter with an official smurf character on the letter head - which was nice

Unless that mis-spelling is yours I wouldn't say that looks like a very professional C&D letter - are you sure of its authenticity?
I received an official letter headed paper from their lawyer it seems in Belgium where they are based, looks pretty authentic to me !

Although this is a UDRP decision and not a Nominet DRS case, it does provide you with some more information: http://www.arbforum.com/domains/decisions/137033.htm

Belgium?
The smurfs live in a village hidden in the woods, and if anyone finds it, they use smurf magic to make people forget where it is.
Then again, I have a hard time remembering where Belgium is in its entirety.

Just coincidence that Mr Berryhill offered such a whimsical reply AFTER 4:20??

The secret is the J Berryhill IS a smurf!! Has anyone seen a picture of him when he wasn't blue?
Howard Neu, Esq.
Ah, you figured it out, Howard. Yes, I'm hiding out in a smurf village with all of your clients who are evading service of process.
We even found the cookie recipe used by the Keebler Elves next door:

It must be lonely there in that village with only one other person named after a recipe.)

The Keebler recipe reminded me:
Many years ago I found a small pebble in a box of Keebler cookies. I wrote to Keebler and told them no harm was done and I was seeking no damages but I did suggest to them that they have the elves remove their shoes after romping through the forest and climbing back into the tree. They enjoyed the humor so much that they sent a HUGE package of coupons for free cookies and I received letters from several of the staff members saying the humor made their day!

How long ago was that? A successful recipe should be tried more than once![]()
