You can be sued any time, for anything. I would not worry about a three-letter trademark in an unrelated business UNLESS it is very famous, like IBM or AOL, most of which companies already have their three-letter .com's. In my non-lawyer mind, most three letter combinations can stand for so many different things that they are usually not distinctive. But it is one thing to be "in the right", and quite another to be willing to spend a bunch of money fighting to prove it.
