buying stolen domains?

Hello,

say i bought a domain from some user using sedo or escrow or direct bought and it showed that the current owner has hijacked the domain in anyway and after buying the domain the old notice just noticed.

what might happen in the 3 cases:
1- using escrow
2- using sedo/afternic
3- direct sale

would the domain go to the old owner? eventhough he is the one who approved the transfer confirmation (his email address)

would the old registrar poll the domain from me?

can i get my money back incase such thing happen or i need to reach this user?

say i can't reach him would it be a lost case for me!



the reason i'm asking this there is that name which has cheap price compared to its market value.

You are saying that you are going to buy a domain that you know has been stolen

i'm suspecting its stolen imagen someone offer you domain.com for $500 ? or business.com for $1000 ?

whois shows he is the legal owner and the update date isn't new dec 2002 but why he wanna sell it this low?!

It could be an oblivious end user who doesnt know the value, but its doubtful.

Be very careful. Get a contract written up, signed etc.

Check Dialog.com for previous owner details and archive.org

Email all email addresses you can find who are assocciated with the domain (found thru openaccess and archive)


IF you did purchase the domain from a thief who stole the domain, it doesnt matter if its sedo, escrow or direct sale.

If the party who had it stolen wants it back, your generall SOL.

The person you bought it from will have disappeared with your money, and you would not be able to keep the domain if you tried.
The registrars will transfer it for you

it used to be with netsol and now its with enom and he will push it to my account

could enom reverse the push for any reason? if he claims or something?

yeah i'm looking at signing up a contract, but would the contract be valid if he stole the domain from the very old owner?

Enom has control over all domains registered there.
Verisign has complete control.

If the domain was found to be stolen, it most likely would be taken out of your account immediatly and transfered back to NSI.


The point of the contract is to prove valididity of the domain he owns.

actually enom will not hesitate to pull the domain out of your account if the domain is stolen. It does not matter about your contract, you can take that to court but I observed many cases example is ks.com bought on escrow at afternic for 10k i believe was found to be stolen and enom just took it out of the guys account.

well if the update day is 1 year back i doubt it stolen, because if its stolen i think the owner would know he lost his domain and will try to get it back ASAP, not wait for 1 year ?

Not just enom.

Many registrars have done what NSI/VS dictates.

Considering (imo) NSI holds the most large amount of valuable domains, most likely, the domain will be @ NSI when you buy it.

This should tell you something. Netsol = mostly end users. Enom = mostly resellers.
