    Can .com owner sue .net owner?

    There is a very well know magazine, let's call it "CoolWorld Magazine" and they
    are part of a large publisher. They also own CoolWorld.com to compliment
    their magazine.

    I just picked up CoolWorld.net...

    Is there a problem sending CoolWorld.com a letter asking them if they want
    to purchase my .net extension???

    Can they legally take it from me if they don't want to buy it?

    Well, I am not a lawyer but can give my opinion.

    Contacting them potentially opens a door to a udrp/wipo etc should they take that route and MAY be used as evidence of bad faith. Also be sure not to use/park the domain with ads for magazines etc, similar use.

    In saying that it's not an automatic loss and if the name is worth losing, contaxt away, keep a reasonable price in mind and live and learn.

    Can they sue, yes. Can they win, I would think that you contacting would help them. ...for that matter, I would think this post would help them. If you really want to do something with it then develop a site about the cool world and wait for them (or someone else) to approach you.

    I can assure you that they can legally take it from you, whether you contact them or not -- and if you contact them offering to sell it to them, you'll make that very easy on them.
