"States clearly at the top of site that i'm not acociated with them" ...actually they could argue the 'confusion' issue by this kind of wording on the website. They would use this as evidence of confusion, even though confusion by third parties has not been substantiated. It all helps their case i'm affaid. Personally, I would remove the statement and let THEM prove the confusion element of the test.
