Without even looking at the web site, my first inclination is not whether you'll receive a C & D letter from Snapple, but rather, did you check to see if SNAPNAMES.COM has trademarked their name? Even if they haven't, that's where your C & D will come from.

Why exactly do you want this name anyway? Is it really worth the potential headaches and legal trouble?

I am no genius but realisitically couldn't Snapnames/Verisign/etc use this thread as evidence of your bad faith intent?

And another realistic thought, do you think having this snapple fan site has any bearing on whether WLS happens?

I hate evil empires and all, but you have to pick your battles.

Thanks for bringing this to my attention

    Howard and Wildcard,

Thanks for bringing this to my attention. You have a good point that Snapple probably wouldn’t be the one to take issue with my site as I originally had asked (In case you wondered, the first post on this thread originally asked if my site might be in danger of infringing on Snapple's Trademark).

I emailed SnapNames just in case and as is stated in their email I’ve included below:

“We don't need you to transfer that domain to us at this point. If you were using "********.com" to sell domains or domain-related services, however, it would be a different story. If you want to, you could put an unobtrusive link to SnapNames.com (something along the lines of "Looking for www.SnapNames.com?") at the top of your page.”

I added their link to the top of my site, as they suggested, in case people came by accident. I was very suprised by how friendly and helpful SnapNames was in their Emails.

Moral to the story: If in doubt about a domain, email and ask the company. Don't assume that companies are evil because if you give them half a chance, they can be downright generous like SnapNames was to me.

    SnapNames Agent,

The name was being used for my Snapple Names Fan Site (********.com) (I'm addicted to that drink).

If you feel that the domain is too similar to your trademark, I would
not mind transfering it to you if you wouln't mind reg cost.

However if my domain name is harmelss and I can leave it with the
Snapple site, that's even better. Either way, I will be compliant.

    Sincerely,
    Tim

    Tim,

We don't need you to transfer that domain to us at this point. If you were

it would be a different story.

If you want to, you could put an unobtrusive link to SnapNames.com

of your page. If this interests you go to

    Best,

    Just a personal opinion:

I DON'T think "snapple" could be considered confusingly similar to "snapnames."

You don't have to do anything. Use the site for whatever you want. It's your domain name.

Why are so many domain owners on these threads so submissive towards corporations? Where's your self-respect?
