Do you think there will be any trademark issues with a forum...

entitled the SixersForum.com. A forum dedicated to the very popular NBA basketball team the Philadelphia 76ers who are most commonly called the "Sixers".

Hmmm, some things you could do...

1. Use it as a legitimate forum. Try to keep out any commercial hints.

2. Include a disclaimer at the top.

There shouldn't be trademark issues as long as you intend to use the domain
as a forum in the first place. Shouldn't be, anyway...

Thanks for the reply. Do you think putting Google AdSense on the site would be too much? Yes, it's going to be a forum but I would like to get some affiliate revenue out of it. Do you think that is possible?

That's why I mentioned about adding a disclaimer at the top. Although it can
suggest you already knew beforehand of the potential complaining party's TM,
at least you're saying you're not affiliated with the TM holder in any way.

If you can keep it out, so much the better. But it's your call.

If you do anything to make money off the site, it is infringing on the TM. If you truely are a fan, then make it a fan site. Make no money off of it what-so-ever. That includes PPC, adsense, subscriptions, links, merchandise (unless you get written approval from the 76ers).

I have fan sites and defended them successfully. You would be amazed at what I have. And at no point have I treaded over the "bad faith" area. That is why his attorney gave up. And to let you know, this person is concidered the "greatest of all time" in his sport.

You dont have to profit from the site to infringe on a trademark and Disclaimers are not a get out of Jail free card.

You can get permission to use the name, and thus will allow you to use advertisments to justify running costs, however the advertisments should not bring the TradeName into any disrepute.
