Escrow.com Scam - Need Advice!

I feel like the domain name itself [domain].com was not returned in the original condition it left me, due to the reasons I have listed.

I understand. But please don't take my replies personally as I beg to differ.

A domain name is just a...name, a label, a term, something we humans love to
put on something to describe it. Morever, since the website content (if any)
of a domain name can be changed, they're not necessarily synonymous, are
they?

I'm probably wrong on certain counts, but many people buy domain names not
just because of the name, but because of what they're going to let the name
"show" or "talk about".

Look at business.com, men.com, and (more recently) rugby.com. Each has a
website content with the potential to rake in money for its owners, which is
what the owners had already planned ahead prior to acquiring those names
(though I don't know what rugby.com's contents will eventually be since it's
a recent purchase).

In your case, it's unfortunate the Asian input porn content on the domain
name, thus giving many of its visitors the undesired impression what the site
is about. Based on your initial posts, it looked like he/she was actually after
the contents (your scripts) of the domain name , the name was just a bonus.
(although I can be wrong, just guessing here...)

That's why I'm actually disagreeing with you when you say the domain name
was not returned in its original condition...because it never really had any
condition to speak of in the first place except for the contents attached.
Rather, you're probably concerned about the perceived value to you.

However, I won't argue that the Asian did cost you opportunities.

Ultimately, the answer to your question is actually up to you. While I haven't
gone thru what you went thru, is there's any value (or use) in crying foul
over spilled milk?

davezan1, you have some very valid points.

My remaining stand is that the domain name itself is being associated with the "hijacked" content. The visitors that saw this website will associate that domain name with the content that he used like this which to me personally means that the domain name has been degraded or damaged and is not of the same value it was. (even though this may only take off 10% or less of the value , it is still something.)

I feel like I'm going in circles at this point and it just really comes down to is it worth it or not and if it is worth it what can I realistically expect out of this. My thought was maybe the buyer will get frustrated in waiting 60 days and give in to offer me 10% or so as compensation for this evil act, since he knows he did something very wrong in putting up that type of content and probably trying to kill my sale.

You say you estimate damages at $1000 tops ... for that amount, it doesn't seem worth the hassles. Just let it go and avoid corresponding with that person anymore for any reason.

If it's any consolation, the buyer will likely *not* get all their money back because they canceled the transaction. I'd expect Escrow.com will deduct the escrow fee, plus wire costs, etc too from the buyer's funds - so you'll still get some satisfaction in an indirect way
