If the seller is able to obtain the "authcode" and can unlock the domain, then it's a no brainer - transfer the domain into the registrar of your choice. It will save you a lot of grief.

On a related note, in some instances, for whatever reasons (lazyness, lack of knowledge, etc) a seller will do little to nothing to help facilitate transfer after selling a domain...

In those instances, one should seek the path of least resisistance - in your case, get it unlocked and the authcode, and then take it from there.

Ron

Addendum:

According to NameSecure's FAQ:

Quote:
How can I get my authorization code for domains that I want to transfer away from NameSecure?

You can receive your authorization code for your domain by logging into My Account, selecting the domain you want to transfer and then clicking "Request your Authorization code" under Contact Modifications.
Request the seller to unlock the domain (if they haven't already) and then do the above ... then have them email you that authcode. Then you're good to go.

I still think the seller is taking the p*** and making out that he cannot unlock the domain and get the auth code. That is utter BS if ,and I say IF, he actually owns the domain he has sold.

If a person is a scammer, contracts typically won't help one iota, and often even less so when done on-line / fax unless one already is certain who they are dealing with...

Sueing a scammer is basically pointless, if they have no money to go after ... but even if they do, collecting the judgement may be still prove extremely difficult.

How do you truly know this? ... one can't rely on emails nor even phone conversations alone. Scammers can easily research someone else's identity on-line and then masquerade as that person to facilitate their con.

Six weeks ... yikes! That's a lot of time; where has the seller been?

domaingenius is likely spot-on about something not being right with the seller.

Bottom line is forget NameSecure - focus on dealing with the seller ... get the authcode and domain unlocked - the seller should be able to do both these things, without any assistance from NameSecure, from within their user account.

What do is this. I would (a) concentrate on pushing the seller HARD to get the domain unlocked and the auth code (b) Find a lawyer nearby the location of NameSecure and contact them with view to writing/faxing to NameSecure to request the matter be dealt with urgently. The lawyer could hand post the letter for you !.

Subject: NameSecure Sucks
- by Onetime Poster of www.aol.com on 25 Apr 2008:

" I don't ever post in forums, but this company almost screwed me so royally, I feel like its my duty, so I will post this in very forum on this topic I can find.
Quick summary, Wanted to do something unique with web forwarding options, after many emails, got tech support on the phone. Could get it our problem fixed, told them to reset the site back to the way it was before they tried to make their changes, My entire clients site on a Cms was gone. The database was magically missing. Oh, and wait.......Now they don't answer the same phone number they went out of their way to give me. what a coiencidence. Anyways, After calling a million different places.(apparently they dont want you to be able to get tech support on the phone) I got this number, which connected me to the real namesecure support people. The ones that get your emails, are the people who namesecure outsources their tech support work to.
Ohhhhhhhh, thats why you can't get them on the phone, they aren't even really apart of the company, thats why they deleted my database, on accident, which they did admit, and I have it on tape. Anyways if any of you are like me I am sure you were frustrated with not being able to get anyone on the phone.

Try this number - people there were nice, dont take your anger out on them. They will actually try to help you. I dealt with some guy named micheal. Micheal is a rock star.

954-535-8495 "

Hope you saw the phone number, here 954-535-8495

Well, did you call 954-535-8495 and did they sort it ??
