It is a standard non-compete form that employers usually have new hires sign. It is strange that after a year they are requesting he sign it. I know for mine it is only 1 year and not 5 years and you sign it the day you are hired. Personally, I'd have him request they create a new document with the current date. This way they can't say he did something between August and November and having August's date on it he goes to court.

well my friend started a project that will benifit the company greatly, and he registered 2 domains in october that the company likes alot

the domains/website is in the same line of the company business

thats why i think the augest date is there, so the company can take the website/domains away.......but the domains are in his name

thats why my friend asked me for advice on this, i should have mentioned that in first post

Re: Letter from work, Need Advice!

I don't see how a non-compete contract would have anything to do with a domain or website unless your friend has decided he was going to try and start his own company using the sites or sell them to another like company.
Either way it seems as though he has a choice to make. Are the two domains worth his job?

As far as the non-compete, as stated earlier its common for companies particularly in sales. But I would also have them change the date. Most companies won't enforce non-compete's unless you try to lure employees away from them.

Definately have them change the date BEFORE he signs anything and make sure he gets a copy of the document too.

Re: Letter from work, Need Advice!

I would try to get the time period reduced to 6 months or 1 year max. For a fast moving industry like most internet focused companies 5 years is unreasonable.

lol..please tell me he really wants a position there..

Otherwise, it's not worth being under contract for even one year. He's getting paid below minimum wage..that's worse than a job at McDonald's! He shouldn't sign anything..it's very easy to find a job above minimum wage..with no contracts to sign (refer to Mickey D's )
