MyFloridaPage.com- C+D from State

Hello

I own www.myfloridapage.com

I just got a c+d from the State of Florida regarding Trademark Infringment etc..

Thier trademark is "MyFlorida".com .........

I dont see the infringement here. Its not a typo, there are hundreds of myflorida websites already active.

I think this C+D could go either way but im not sure what to do......Do you think UDRP would vote in thier favor?

When a user goes to "myspace" does he type in myspacepage.com? i think not...its apples and oranges..(hopefully)

any thoughts will be much appreciated

Same as if someone had MyMicrosoft.com. Microsoft would be sending them a C&D for their trademark of Microsoft.

Seeing you have no ads on your site and it appears to be a personal site, I doubt you would have any problems. This is just my opinion and you should seek paid legal advice to know what you should actually do.

The main problem is that MyFlorida.com is a government web site.

They hold three registered marks:

The C&D is not a decision, it's a "warning" to comply with their request, or else they would proceed as they see fit to protect their tm. This could include the filing of a UDRP, a lawsuit for punitive damages or both.

This is a stupid trademark. I would tell them to get lost.

I am not telling you to do the same thought, especially cause you live in USA.
