This doesn't seem right, they are not connected with Fabulous so not sure how they can get the name.

I had thought 40 days was the max they were allowed to go in and take back. The name is registered at Fabulous Names. Is this legal?

they are going to need your co-operation to get it back. i wouldn't give it back.
I purchased the name on Nov. 17th. I got an e-mail from them today:
Here is the e-mail:
We regret to inform you that a domain you recently purchased through a pre-release auction has been cancelled by the registrar of record, as allowed by the NameJet Agreement. We are not provided with specific details and therefore do not have any further information to provide.
As a result of this Registrar request, we will be refunding the entire auction fee and removing the domain from your account within the next few days. Please be assured that this is a rare occurrence, and we do apologize for the inconvenience.

First off, why hide the name?
Any way, Id push it asap to another account or transfer out.

So hiding the name does what for you legally?
Nothing and now that they took it already you will spend easily between $5000-$XXXXX to fight for it back which as you know may not be the end result. How you cannot push/transfer a name after 80 days is amazing to me, usually its 30 dyas +/-.
Isn't Registrar lock 60 days with NJ? Good luck with this. I'd be pretty pissed off.
Each registrar sets their own time. Apparently for Fabulous it is 90 days. Yes, I am upset. It is a matter of principle to me that I feel I just got (*Y&(&* and no one said thank you.
If a fab account had a 90 day lock it is the longest lock I ever heard of, maybe why they like using them lol

That's unbelievable, and it just doesn't seem fair.
I had something similar after winning a dynadot auction, but it was within days, not months.
The previous owner can still redeem the domain even after it's been awarded in auction.
That's why domains won through NJ remain auction-locked for 6 weeks.
Same with GoDaddy auctions, names can still be taken back some time after you won them, but it seldom happens.

80 days is about 11 and half weeks, what kind of registrar lock is this one?

I don't understand this:

How can a name be cancelled?
Does pre-release mean it was dropping, went to auction (yes, I know it does), but it was so far out in the pre-release that there was enough time between when it was won and the owner was still allowed to be taken out of redemption by the owner???
Why do people keep f'cking around with these auction places like that.

That happened to our company about 6 months ago: NameJet and Fabulous.
The time elapsed was about a week, not months.
