    I guess WIPO has been busy lately - I noticed my emails from them are a lot longer (rulings).

    I think this I the first time I've seen on of the panelists "dissent", too.

    I've seen a lot of panelists dissent.
    I don't remember the presiding panelist dissenting. That is kind of funny.

    The dissent is that the ICANN dispute policy should not come into play when there is litigation underway. That is the correct finding because the UDRP is only for a small suset of disputes for "abusive registrations" as disussed in the ICANN staff report for the development of the UDRP.

    Do you think "litigation" would encompass say a trademark objection ,which
    after all is a process that is heard much the same as in a Court ,and infact
    next stage after the initial hearing is in Court ?.
