    3 newb questions related to bad faith

    I'll try and ask general questions.

    1. If I have a website on example.com that is successful and someone registers wwwexample.com and examplecom.com is this obvious bad faith and how hard is it for me to get control of those domains?

    2. If I have a successful site on a brandable name, like "Jamfu" for example, that sells weddings rings. Someone else registers "Jmafu" and sets their parked keywords to "wedding rings", does the act of setting the keywords to match my site prove bad faith? Do I have a course of action?

    3. I register the plural of a two word domain like LovelyWidgets.com for example. LovelyWidget.com was already registered. I develop my site and it becomes successful. 5 years later the other site is and always been parked and for sale with the owner asking an extremely inflated amount due to the success of my site. Do I have any course of action?

    My wife and I have been end users for years now and we've just recently gotten into domaining. It's been interesting learning about the other side. I sure wish I knew then what I know now.

    I am not a lawyer, I do not play one on TV, nor do I look like one.

    1)Do you own a trademark?
    2) Is Jamfu trademarked?
    3) This one would be hard to get. A recent ruling on MySpace.co.uk was overturned in the owner's favor since he had it long before MySpace.com was even created.

    This is what WIPO will look at (after you pay them of course). It might be harder to get the domains w/o one and the $1500 is non-refundible if you do not get the domains.
