Guys, should I risk my neck on this?
Guys, I need your help.
I see this one glowing name of a magazine. Let's call it xxxxxweek. It's somewhat famous. This company, obviously, owned the dot com domain name. Then God (or satan?) opened my eyes so I can see the dot org just right across the street.
I know I can take this dot org fairly cheap. I know that the current owner of xxxxxweek.net never had any issues before since the year 2000. And I know I have the upper-level contacts of xxxxxweek in my hand right now.
Should I risk my neck on this? What would you do if you're in my position?

If you offer to sell it to them then that is a good amount of ammo for them if they file a WIPO. Personally I'd stay away but others here might jump on it.
If you do jump on it, be extremely careful how you go about it.

2.Contact the Company
3.Sell it
In case that doesn't work out and it also doesn't have any traffic you can drop the domain since it's recently registered

You ARE cybersquatter if you register domain with purpose to sell it to .com owner for profit. But, again, many people do it anyway.
Wikipedia says registering, trafficking in, or using a domain name with bad
faith intent to profit from the goodwill of a trademark belonging to someone else.

There is always a level of risk in this situation.
On the other hand, I have heard many stories of domainers getting a decent amount for domains from companies even after the company threatened legal action, they were able to negotiate and ended up selling the domain to the company.
Depends on the company you are dealing with.

There are many out there that believe and write and label anyone who owns a domain name without a developed site is a cybersquatter simply because that person is not allowing someone else to have it.
My point is there is no risk in being labeled a cybersquatter if there is such a loose definition of the term.
Now, being labeled as in defendant in a TM infringement case? Especially when you know better?

The 2 word domain is general and can be developed in many other ways. Depends I guess. If you don't have a plan for it and intend to solely on parking, advice would be a no.

Yeah, some people could make a profit out of this. Besides, why the heck the company didn't wipo the current owner of the dot net? It's currently at whypark.Depends on the company you are dealing with.
