    NICE name Scoop!

If I were a photoshop expert looking to develop, I could justify mid x,xxx

If I were a reseller trying to make money on it, I would lowball the sh*t out of you, lol & try to get it for high xxx - low x,xxx

Its a great name, best of luck with it

Except that Adobe® actually has a registered trademark on Photoshop®.
Profoundly influenced by #Bauhaus, @Nameslave unrepentantly embraces #Minimalism in his #multimedia portfolio. His early works include an experimental adaptation of Chekhov’s Cherry Orchard inspired at least partly by Robert Fripp. His totally irrelevant M.Ed. dissertation examines Organizational Culture and Change Management.

Looking at the plural of the name site, you may need to add this:

We are in no way affiliated with Adobe. Photoshop, Adobe and related marks are registered trademarks of Adobe.

Now, does a statement like that alleviate them from litigation? Not sure.

It's a good name, a popular software, and a huge following. So, it may not be a bad idea to talk with an attorney and even run this by Adobe.

Without precautions, its risky to put a lot of money into developing.

agree w/ DocCom. better safe than sorry. but large software vendors generally rely heavily on reseller sales and support, and i can tell you i've seen more than one magazine on the mag rack in Borders that uses Photoshop in their title, though its possible they are all licensing the name. i dont know where the line is drawn in these cases.

It's not damaging to their brand. Forums would assist users in obtaining a better understanding of the Photoshop software, enhancing the user experience of Adobe's software, thereby increasing likelihood of referral and repeat business. This also puts less burden on Adobe's tech support team, thus lowering their costs.

Additionally, I would think that ever since Merriam-Webster put "Photoshopped" as a word in their dictionary that Adobe's ability to hold up their rights to the term in court would become much weaker.

Take a trademark like "Blackberry" for example. RIM has won dozens of WIPO cases for domains containing the term "Blackberry"... however, sites such as Blackberryforums.com and Blackberrycool.com still stand as third party forums.

I think you can develop the name without issues... but I agree with doc com about making a blatant disclaimer that you are in no way affiliated with Adobe, and that they own the trademark.

To be safe, I would contact Adobe's legal department before pursuing anything further.

    Just my $0.02.
