    received an offer for zride.com.....pls help

    I received an offer for zride.com for $200. It is a bit complicated since they made an offer back in July which I turned down adn then they filed to trademark the name.

    Any thoughts on this?

    Should I be worried about the fact that they mentioned the trademark? I was developing a Nissan Z related site, but may just sell it now.

    "I will offer you $200.00 and we do have a federal trademark for the work Z RIDE. You can search at(www.uspto.gov)... I can't imagine the word zride.com is in high demand so let's do this deal!"

    From everything I have read and heard, if you had the domain BEFORE they filed the trademark, you have no problem.

    does their trademark matter? i mean you registered the name 6 months before they registered the trademark (which they did after you legitimately turned down their offer).

    if they make any threats when you counter you should put this up in the legal section as i would be interest to see what jberryhill and ari goldberg etc have to say

    Let them know the more development time you put in on the future site, the higher the price goes.

    Well, the legal experts here have said several times that you have little to worry about bad-faith declarations if you registered the name before a TM was applied for or issued.

    And after checking out the sites listed above, it is definately worth $1k for them to have that domain. I hate to be greedy, but they even say on their webpage that they are excellent sources of branding info - and .com is much better branding space generally than .net.

    they are just trying to get you cheap. Don't let them.

    Keep things friendly. Let them know you appreciate their offer, but you have put a lot of time into developing a Nissan Z site for that domain. I say stick with your original offer -

    "I appreciate your offer to purchase zride.com for $200. Unfortunately, this domain name is very valuable to me, as I have put a lot of effort into developing a Nizzan Z site which will soon go live on this domain name. I am not prepared to abandon the effort I've put into my Nissan Z site for less than US $2000. I have been advised that your trademark does not come into play since I registered this domain before your trademark was filed. Please feel free to contact me if you would like to continue discussion of this matter, however, please don't delay. Once my new site is up, I will be very reluctant to sell this domain. Thank you."

    Tell them 1.5 and I believe duke is right about the timing.
