Post he god domains but do not want to complete the payment

He know I am rushing to gather fund and will sell domains at a lower price.

he got my xx names for $xxxxx and told me it is fair resale /forum price,
he will pay $xxxxx and paypal fee.
He asked me to push domains to him first,and I did.
He fist paid 35% and said no fund now ,he need to add fund to paypal ,days later
he said he knew I had another account and bought a name before from me.
He thought I am not honest to use other account to exchange with him.
He then said:
1.take back names and I pay back to him.
2.Or he will low down the payment to 60% of ogrinal price ,not the original offer $xxxxx
I explained my situation to him ,including the account problem,I just cannot use that account at another forum.
He then said :
he wanted to low down the domain price because he thought he paid too much,
anyway,he would pay another 25% of the orginal offer ,plus the first payment of 35% of original price.
total is 60% of the orginal offer.

I asked him try to proceed the deal via PM ,he never reply and finally said
he was going to pay me but now he thought it was not right to send him message
to push him to pay,he said he was fed up.

I said I am not to irritate you,I am just remind you that :you know I sold the xx domains to you
and you make an offer $xxxxx and I accepted it ,so it is legally a deal and form an informal contract,
I hope he can try his best to proceed it.

Finally he sent 10 % of orginal offer to me and said:this is the final payment or let me get back my domains.

I cannot pay him back because fund is used already.

He thought forum sale offer can be canceled as his any wish,no matter I accepted his offer or not,he can lower the price if he like,and there are many reasons,such as how can I use domain whois privacy protected service,so I am a RISK man. He never want to deal with me at the very beginning,but just want to pay a offer and get names and lower the price and price and never complete the payment.

I gradually think he is a scammer,I hope he should complete the deal.
First I do not think he is professional and make me angry,second,I need the cash.

What should I do ?
Tha forum management team says it is not 'open ' deal,but deal via PM,so it is hard for them to intervine.

I know there are ways,but not sure about the most professional ways.

What a mess!

If this is a member here, this needs to be cleared up.

This is happening too much.

Folks are making up the rules as the go along which includes changing the rules. I don't understand what the issue is...a deal is a deal.

I just completed a transaction not more than 5 minutes ago. I made an offer, the seller accepted the offer, I sent payment, I have the domain. It really is that simple. But people want to screw somebody.

Sorry for you bad deal dnol. Let us know how it goes.

and I read:For your protection do NOT post specific domains that you are having trouble with, post the situations and ask the experts for their opinions.

I will listen to the moderator here if they think I should make it public.

if this deal was done on another forum...imo, speaking as another member here, you should try to settle it there first.

since you dealt via pm, only you guys know what happened.

that my personal opinion.

if there was "fraud" involved and he is also a member here and is guilty of such, then perhaps it should be brought to light.

It would be nice if you could let us know his username on DNF, so we can avoid doing business with him in the future.

Oh and as Onward says; never push domains first.. First you get paid, then you push (unless you're selling domains to your mom).

I might be still naive and think too simply during the deal.
I trust foreign domainers easily and sometimes thought I might not be professional enough,factually I made some mistakes and even got post deleted here and there and might made some name forum mods unhappy.
I am sorry for my simple and might be silly trade experience.

I would give him one last chance to pay you the agreed amount. If he does not pay you the full amount agreed within say 3 days . I would simply say " I ask that you honour your agreement to pay me the the full amount that you agreed to pay". If he does not pay within that time period I would advise him that you are going to instruct a lawyer to sue him. Which Country is the buyer located in ??.

honestly, and ill say it as nice as possible, you need to take a more business like approach to business, and people won't be so inclined to try and walk all over you

i think he should come out and tell his version at least

how about dnol, you leave him 10% of domains as he paid you 10%, and take back the rest?

the other forum "I have no problem closing this guys account -or- threatening him .... But the only thing I could possibly suggest is him pushing all names back to you and you refunding him - Which you don't want. We can't force him to pay you the full amount. Were not the police.

he paid 45% very unhappily and I am not sure if he would like to send back the 55% domains without I send all the fund back.

The best option for you is to urge him complete the payment fully, as that was the deal, and you have pushed your name too early. The buyer must pay 100% before you push the name. Notwithstanding the fact that you both rarely do deals (I assume). That is why we use "escrow" for such transactions. Paypal simply is not good enough for an amount like this.

I see that Shoval has a thread re toy1.com and in the whois record it states his email address as shoval@eskimo.com It shows his address as allegedly being in Israel but I do not believe that is his correct address. Why would someone supposedly in Israel use an email address of eskimo.com who are located in Shoreline, WA 98155 ??? I would guess that Shoval actually is in WA ?.
