User buymynames backed out of our deal - no integrity

User buymynames listed NewYorkStocks.com for sale here and after several bids stated the following:

Ok, received two $1.1k offers via PM.

I will lower BIN today to $1.5k

    --or--

Highest offer before 12PM PST tomorrow gets the name.

    Thank you!
The timestamp on that post reads: 11-09-2009, 11:18 AM

At the following time, 11-09-2009, 12:16 PM - I submitted a bid of $1150. No other bids were made in the thread and then at the following time:

11-10-2009, 03:13 PM (3 hours 13 minutes after his deadline) I received a PM from him stating:

    Congratulations!

    NewyorkStocks.com sold to you PokerPie.

Please send Paypal payment of $1150.00 to xxxxxx@xxxxxx

After payment, I can unlock domain and email you domain login, auth-code.

Thank you and please let me know if you have any question.

    Thank you!
Then he sends me this PM at the following time: 11-10-2009, 09:18 PM (six hours later)

The key portion is bolded and underlined.

    Hello, PokerPie.

I'm sorry about our previous email. Unfortunately, you didn't win the auction.

Someone had placed a higher offer than your offer before the due date.

We didn't see this note, but we see it now from his email to us.

So, I'm so sorry, please don't us the payment.

To be fair, we will need to sell the domain to this buyer.

Thank you again for your business.

    Kindest regards,
Skeptical, I requested proof of this, so he sends me a PM from the buyer from after 12pm yesterday requesting information about the domain and asking how he could make payment (not even an offer). No additional proof was given to me and it is obvious that he simply got a higher offer after his self imposed deadline, went back on his word, and took it.

This sort of thing has happened to me one too many times and I'm sick of it. So many sellers with no integrity willing to break their word at the drop of a hat just to make a few extra bucks.

Even though buymynames had a perfect iTrader rating before this transaction, I would advise against doing business with him as he's obviously willing to throw ethics out the window for the sake of making more money.

Hey buymynames, I hear SnapNames is hiring, I think you'd fit right in over there, go apply!

If everything you've said is 100% accurate...

To be fair, we will need to sell the domain to this buyer.
"To be fair"? What a crock of sh*t. "Fair" would be selling YOU the domain, since they told you that you had won the auction.

Even if they HAD received an offer from the other person before the deadline, the fact that they didn't see it and they told you that you were the winner, as far as I'm concerned it's your domain.

PS - Keep in mind that I only stand by my comments if your account of the situation is 100% accurate.

Yeah, what's up with that? I had been watching that thread and thought and thought about submitting an offer. It ended up being more than I wanted to put into it. But I do recall the stipulations and conditions placed.

Another reason why I do not like the "offer made by PM" nonsense...

Thank you Mods for examining the truth. PokerPie aggressively posted a negative feedback towards me - The sale is not even over yet and we are still waiting for payment from ***.

    But *** outbid PokerPie...

I'm a fair seller, we claim winning bids based from stamp date and time. I think it's fair to give the name to xxxxx, since he came in with the earliest high bid (see below)

    ******* email to us

I already offered you more than that in my first PM to you...

I just got this PM, my high previous offer should supersede this.

ps - would you do it for $1500 if I could pay you via masspay today with paypal (no fees)

Still waiting payment from declared winner.

PokerPie - please stop sending me PMs like below, you will be the winner if the other buyer backs out.

haha just as I said, my negative itrader was removed and yours stands. you are a scumbag, confirmed by the moderators.
    Just so you know...

I've asked the Mods to remove my negative feedback towards you since sale is still pending.

I am curious to know why you would think he would be the "winner" after posting all of this.

Do you think he is now obligated to pay you because you offered this to someone else and that person you declared as the winner won't pay?

@PokerPie - Received an email from other buyer and he will not proceed - which I'm ok with. So, it's up to you now.

I sent you my payment info. If you don't want to proceed with the sale, that is also fine.

@Doc - No. It's up to PokerPie and other buyers, I'm very flexible

I'm still buying the domain (payment already sent) as I'm not going to let this mans poor ethics and integrity stand in the way of my business decision to buy the name - but I'm still going to leave him a negative iTrader rating (and I think the mod who removed the one I left him made a poor decision) - and I request in advance that the retaliation negative rating he is going to leave me be removed.

In other words, if somebody offers me more than $1150 I am once again willing to shaft PokerPie. You really are a bottom-feeding scumbag without an ounce of integrity.
