ABout TMX elmo:
“T.M.X.” Elmo will tickle America’s funny bone with three interactive tickle spots on his chin, tummy or toe.
hen kids tickle Elmo once on any of the tickle spots, he starts to laugh and slap his leg twice, then falls down into a sitting position and rocks himself back up to standing while laughing. When they tickle him a second time, he repeats the pattern even more, then sits down again and falls backwards onto his back and starts kicking his feet while laughing even harder. He then stands back up and asks to be tickled again. And on the third tickle he absolutely lets loose going through the first two patterns and then rolling over onto his tummy where he starts hitting the floor with his hand in gales of laughter, then rolling onto his back, standing up again, and ending with a deep sigh. Requires 6 AA batteries.

How are there no TM issues? The character Elmo is TM'd by Sesame, and you are referencing the new Elmo doll. Additionally, you are using Elmo references. Did Sesame give you the rights to advertise/market the Elmo doll?

The name elmo is not trademarked by Mattel parent company of fisher price.

TMX elmo is trademarked. If you do not know anything about trademarks, don't comment please.

I'm not an attorney, but to say there are no TM issues on this isn't exactly being honest. Not only could it hurt the buyer, but could come back to bite you since you stated "there are no TM issues." Whether Mattel has TM'd the name Elmo or not, you are still using the name of their product without their permission. There are such things as a common law TM...etc. I don't care whether you sell the name or not, or whether someone buys it or not, but please do not misinform people and say "there are no TM issues."

And in addition, the site you has up has images/references to their Elmo doll and has ppc links, proving that your intention was to profit from their common-law TM.

If someone with more experience on this matter comments and says I am incorrect, I will gladly edit my posts. I just don't want someone getting burned by misinformation.

TMXelmo has been trademarked, i know... i've searched.

But whatever... EJS obviously just wants to ruin the thread. you could have discussed this privately.

1) Don't make a comment like "no TM issues" when there obviously is potential for this type of problem. Its better to not say anything at all on the subject rather than saying something which is clearly false.

2) Can you proove your traffic claims?

no, no google adwords as the price of the keyword elmo is very high.

Its all search engine or blog links. Traffic so high today that my stats counter isnot counting any more (unless i upgrade to a paid one).

Maybe i will just keep it... hurry, before i change my mind !

Are you saying you never used adwords? I saw your site earlier today using adwords? Were you just testing.

just testing, not using adwords at all, cpc rate is too high, but works out well for the ads displayed on my website
