When you sell, say, Maxtor hard drives thru affiliate systems or own store, is it illegal to show maxtor pics and logos? Like wise, if you sell lego thru affiliated stores are you violating lego rights by showing their products? If you can say yes to both, there might be a bit of difficulty in developing it, BUT there are zillions of domains that include TM's and you can see them parked and making money. I mean, how is BillGates.com online?
Another important point is that MOST TM ISSUES are solved through amicable buyouts, unless the name registrant is such a moron that he pushes his luck until getting the C&D and later the legal action. TM issues are ended everyday with quick sales, not threats or lawsuits. Those that reach the point of a lawsuit are just stubborn squatters.
Which even more impressive is that some stubborn squatters even manage to keep the TM'd domain by "convincing" the jury that there was no bad faith and also "convincing" them that the TM holder is trying to "reverse squat" them.

Well... what can I say? I just recently sold a celebrity name to the celebrity himself. He made me a decent offer and instead of the stupid bargaining of certain squatters, I just accepted it and it was a quick amicable sale. He could have tried to get his domain name forcefully, but I believe everyone knew it was faster, cheaper, simpler, easier and waaay more friendly to do it that way.
Yes, thats a "novel" way to solve TM and personal domain name issues.
