Angry Expired Domain - Who has rights?

I bought a domain name a few years ago and failed to renew it after a few years. When i finally decided to get it back it turns out the company i registered it with had registered it themselves and refuse to release it even though they have no plans to do anything with it.
I realise its my own fault but is there anything that can be done?

    Thanks

best thing to do would be to buy the name from them since they are the new rightful owners

You have right if you have legal business to support your claim against the domain name. This process will take time, money and effort to accomplish so you have to re-assess if this is what you want. You may want to review the dispute policy posted to the website to grab more information.

    Hope this help,

    A suggestion.

Although legally you may not be in a great position, there is always something you can do. You must take into consideration the registrars position. They probably have thousands of names and help on to yours because they either think it has value or have intentions of developing it. As you have suggested they have no intention of developing we must assume they feel it has value. If you made them aware that you were a previous owner of this domain name, they may think that you asked them to sell in order to get a price from them that you could use against them in a legal battle. This is what I suggest:

Contact the registrar from another email address and do not give them any indication that you have had any previous dealings with them. You may also have a have a mediator do this for you. Do not mention price. Simply find out if they would consider selling the name should the right buyer come along. Once you have an indication that they may sell under the right circumstances, find out what those circumstances are and create them.

If you need help with this process you may contact me at jim@namemediation.com.

    Thank you.
