I own a decent .com domain - for examples sake say carcrazy.com
I also own a trademark for the 2 words that the domain name uses "car crazy".
A large Corporation recently tried to register a trademark for "crazy car" and I am thinking of opposing the regisration which will then go through the trademark dispute resolution process.
Currently the domain doesnt have a website on it. I could put up a website that is identical to their market or one that is a million miles away as the 2 words could mean a number of things.
Ideally i would like the Corp to make me an offer for the domain and trademark but i fear appraching them could show my hand. I am also reluctant to put up a website which is similar to thiers for fear of creating confusion to their brand and them going down the WIPO road.
What do you think my best option is? Appreciate your Opinions Domain Brains
Me thinks -
you should have an ongoing biz in order to protect your TM.
Also - same TM can be owned by diff companies in diff markets
If there are similarities
If you actually own a TM or two
If that TM is actually close to what you own
If the investigating TM Attorney finds this to be true
they may not approve the other party's TM.
If the other party's TM is approved, there will be a thirty day posting for opposition prior to granting full TM.
Keep track of the time line if it gets through the process.
