CARSON CITY — A panel of a federal appeals court has upheld a judgment of nearly $60,000 against poker player Russell “Dutch” Boyd for infringing on the trademark of a Henderson company that produces books and videos about poker and gambling.
The three-judge panel of the U.S. Ninth Circuit Court of Appeals on Friday upheld a March 2012 finding of U.S. District Court Judge Kent Dawson, who held that Boyd acted in bad faith in registering the domain name “Twoplustwopoker.com.”
Two Plus Two Publishing LLC accused Boyd of cybersquatting and trying to divert online customers away from the Henderson company’s website, according to court documents.
The appeals court said Two Plus Two presented evidence it has sold more than 2 million books and has 250,000 members on its online forums.
Dawson awarded $25,000 in statutory damages and $33,985 in attorney fees, saying the infringement by Boyd was “deliberate and willful.”
