I recently purchased a expired domain, however I did not conduct a TM search. Turns out the domain name was in use under a registered trademark. For example, the register mark is "The hand Comb" and the domain I purchased is "handcomb.com". This is too close for comfort to carry in my portfolio.
So, in good faith, I have contacted the previous owner to transfer the domain. However, they have been very rude in the replies and I'm now concerned they may embark on future action. If it wasn't for my follow-up email did they realize their domain and site had been down for several months.
My question is this. Should I require a signed letter that prevents any future action, if chosen, against my company. I may be stretching this far, but I would like relinquish ownership of this domain for good. If you have any examples of letters or verbiage, please PM me.
