Director Spike Lee has won his domain name case against a Philippines-based operator who misused the domain name, spikelee.com, to redirect surfers to a pornographic Web site, arbitrators ruled Friday:

That's not really a win. If someone is going to be that stupid as to misuse celebrity in such a blatant manner it's kind of a slam dunk. He should seek damages as well.

I'm not 100% sure that it's THAT clear-cut, as Spike actually SETTLED (out of court) with Spike TV. My take is that it depends on your POWER (a.k.a. resources).

Btw, Mercedita Kyamko the old owner of the domain still have a chance of keeping the domain name.

right, the loser can appeal the decision, but I highly doubt it will be overturned

When it comes to the legal battle ground (court, instead of WIPO arbitration), the rules of the game is *a bit* different. Again, your resources matter much. But since we have Spike Lee (the more "powerful" party) as the winner in this case, I too don't see much chance of an overturn.
