I feel other board members should know that I purchased red.ca from the seller and paid Escrow.com. The seller did transfer red.ca to me and requested that I release the funds right way. However, our agreement with Escrow.com was that we had 3 days to make sure that the domain name was in my account. When I checked on day one, it was there, but on day three it was not and the seller (through cira.ca) claimed the domain back. Escrow.com still has my funds as the seller claim's the returned domain is damaged goods. Currently I am out my funds and the domain name.
This transaction taught me that when buying a .ca domain name from a seller, that you must open an account at the sellers registry in order for a smooth transfer and the ability to change the contact information into the buyers name. Cira.ca puts a lock on all .ca domain names transferred from one registry to another. They do not allow the buyer to change the contact name for 60 days.. This means the seller's name stays on the .ca domain name for 60 days, allowing them to claim it back. (This does not happen with a .com, .net, .org). Cira.ca claims that this is in place to stop fraud, however what it actually did was allow a dishonest seller to try and walk away with both the buyers money and the domain name.
My lawyer stated today that Cira.ca is now in the process of looking to change this 60 day rule in light of what has happen to me and this transaction. Both Cira.ca and Escrow.com have been great with how they have provided the required information for my lawyer to issue a statement of claim against the seller.

Furthermore, listing red.ca again for sale when he knows there is a 60 day lock on this domain name and that it can't be transferred out to anyone shows that he may be looking for another forum member to take for a ride.
This is not my forum, but if it was, I would ban this seller to protect other honest domainers who come here with good intentions.

There is pending litigation and the domain is locked. furthermore, we just found out that www.redresort.com may have issue with the seller. Good luck!

At this time, I have been advised not to comment on this matter. However, I can say, Escrow.com and Cira.ca have been very understanding and helpful.
Escrow.com released my funds back to my credit card yesterday (minus the fees).
My lawyer had prepared an injunction, but this may not be required now. I will know more after the holidays.

For the record you can transfer a .ca domain and have it updated to the new registrant info right away. The problem is almost every registrar fucks it up. Namespro is the only one I know that does it properly. Godaddy is beyond belief in their inability to accomplish this.
I have had multiple discussions with the people at CIRA about fixing this and making it simple. The 60 day rule was originally put into effect on behalf of the registrars to protect them from CC chargebacks a decade ago. I disagreed with that at the time because my CC allowed up to one year anyway and I didn't feel a quasi gov organization should be acting to protect commercial business transactions.
I have been told the CIRA is looking for a simpler solution to the transfers and elimination or roll back of the 60 day rule. Anyone that wants to write them to put pressure on them PM me and I'll give you the responsible people.
The other issue that arises in these transfers when not done correctly is the new owner has the domain and could theoretically do almost anything including illegal activities that would fall back on you because it's still in your registrant name.
Also Escrow wants to see the whois in the new registrants name but with privacy or screwed up transfers that becomes impossible.
I am not commenting on the honesty of the seller here just clarifying some incorrect info posted.

I still don't understand people when they buy a .ca from me wanting to transfer it to GD...even after I explain that GD (and others) can't handle the RAR and RANT at the same time.
I still get emails for names I sold 6-8 months ago from GoDaddy letting me know it is due to be renewed

After the last half dozen screwed up transactions (all involving godaddy) I insisted that the last buyer open an account at Namespro. That is all we will do in the future. Push it there get the proper registrant transfer done and have the domain in the customers hands and ourselves paid.
<Rant>I'm doing this because sooner or later one of these situations is going to blow up and watch the Cira/Godaddy rats scurry for the dark corners....</Rant>
