Brokering Question

Hi,

I may be brokering for someone soon,I am a bit new to brokering so I just have a few questions.
Lets say someone buys the name,and lets say the seller backs out or does not transfer the name ,Am I responsible for what happens?

I don't see how you could be resposible for someone elses actions , I would always use a TOS when entering into a contract with the seller and buyer though.
