This is the reason why I refuse to use Escrow.com as a seller: it's insecure. As buyer you should also be careful:

- never let the seller create a registrar account for you and give you the password
- make sure that you don't accept a push to another account at a small registrar. It might be a reseller account that is controlled by the seller.

Safest is to ask for EPP codes and transfer out.

Basically, if you don't get the release of the funds within a day, get on it like a dog with a bone, you have around a weeks window of opportunity to make sure you get the money, or at a minimum have it sit in Escrow and not released back to the buyer.

The worst thing that can happen is the domains are stolen, that's the biggest risk IMO. This is a rather unusual case i think, but I'm confident it can be sorted given the WHOIS info is frozen ATM.

How does thsi happen what with the 60-day no transfer rule upon ownership change?

Did you do the transfer to Enom before the dust settled?

60 days only applies to transfers between registrars, except for GoDaddy who applies it to all changes of whois details... (which sucks, since I never keep domans at GD, but anytime I buy one I have to wait 60 days before it can be transferred.)
For pushes between accounts, (at other registrars), it's normally about a week.

Why would this suck? This is a big plus for Godaddy IMO, which is why i keep all my domains there. Enom took domains out of my account without even letting me know! Friggin Sedo let me know that i was being scammed at Escrow.

If you fart Godaddy sends an email letting you know about it

Dozens of transactions with Escrow.com as a seller/buyer - never had a single issue. Bottom line: when you set the inspection period to anything beyond 1 day you are digging your own hole.

I just got this from escrow.com they also sent one to the buyer

Escrow.com has confirmed directly with Moniker that the following occured; *The buyer received the domain in his Moniker account on 12/8/09 *The buyer authorized a transfer request to Enom on 12/8/09.
*The buyer returned the domain to the sellers Moniker account on 12/14/09.
*The transfer request to Enom that that buyer authorized on 12/8 was successful and the domain moved from the seller's Moniker account to the buyers Enom account.

I can confirm that the domain transferred away from Moniker on 12/15 to Enom based on the request of the Buyer (buyer) submitted on 12/8 through the buyers Moniker account. The transfer request was authorized by the buyer with the email address ( buyers email) which I can confirm is the buyers email address. The domain should be in the possession of the Buyer at Enom. Thus the domain is no longer at Moniker or in the Sellers??? (James ) possession at Moniker."

If their is any Escrow.com reps looking at this then what more do you need is this what we pay you for to insure every thing is safe.

I think they are telling you too bad and you need to file a lawsuit and they are washing their hands of it. They can do that in the TOS I imagine.

I know escrow.com had their State of Arizona Escrow License suspended a few years ago. I believe they are now registered in all states however since you are not in the U.S. I am not sure if you can file a complaint as you are not in any of the 50 states. Maybe they are reg'd in the U.K. too?

This is a major problem with escrow.com I discovered years ago in that the escrow success relies heavily on the honesty of buyer and seller to complete the transfer since escow.com never assumes temporary ownership as they should be doing and if buyer or seller default escrow.com can simply say hire an attorney. The main thing that makes them seem secure is by virtue of their domain and little else.

That email chillking posted makes it sound like they are agreeing with him that the buyer received the name. Aren't they just going to release the money to chillking and the transaction is done?

I'm more confused now.

I read this, (rather confusing as it is) that the buyer has the domain, the funds should now be released, am i missing anything?

ydnaemsti can i ask who you are and do you work for enom.com ? thanks.

Who is the Buyer? Not just his name, where does he work? what does he do? Is he like VP of a company?

How did you get in contact with him. Sometimes you need to go back to the start and retrack your steps...is this a company or enduser...or is this a Scammer?

Who approached who?

It might help if you walk us through how this happen...maybe you were setup from the start or did this guy just change his mind.

Either way you should at least get the domain back. Have you talked to the Buyer? If you don't have the domain...Report the domain stolen by Mr X...call the police have him charge...might make him move his feet.

Just spitting out thoughts!!!

Also guys if you look at this Escrow.com has confirmed directly with Moniker that the following occured; *The buyer received the domain in his Moniker account on 12/8/09 *The buyer authorized a transfer request to Enom on 12/8/09.

It says the domain name transferd from my account to the buyers account and the buyer authorized it , I though if a domain is in your moniker account and you are the owner only you can transfer it ? So if their any one from moniker who can let enom.com know the domain was transferd without me even knowing about it and ask for the domain to be transferd back to me because its a fraudulent transfer.

I do not work for enom thanks god. I linked the last domain scammer stealing from GoDaddy through an email. If you're for real and have the info let me know. I hate to be a cop, but I'm hit with scammers every other day, so I know most of them.

Stewie i do not want to publish the buyers contact details here yet but i can confirm he is not a domainer and he is a manager of a company.

ydnaemsti Escrow.com have the buyers full info and so do moniker i do not think he is a serial scammer i just think he got a oppertunity.
Also what you just said (If you're for real and have the info let me know.) that sends alarm bells ringing you think im posting here for a joke and asking for reps from enom.com moniker.com and escrow.com

Update from moniker

J- I believe it was a timing thing, as the domain was pushed back to your account right around the time it left. This is being looked into but this appears to be the product of the circumstances not a fault of services.

Is the Escrow.com transaction being cancelled? If the buyer has the domain escrow.com should release the funds. Are they not assisting you?

I’d like to be sure we do not start a process that only jeopardizes things further. I will have to consult with my legal team to understand our options at this point. I may need a statement from Escrow.com stating they are not releasing funds to you.

Once I have our options sorted out the method to retrieve the domain from Enom will take a few days to have all parties agree to returning the domain, then the domain transfer back to Moniker will take 7 days (normal transfer time). We are looking at about 8-12 days minimum.
