Does anyone know anything about seller "gabrpryr" on eBay? He has some nice names up for auction, but the whois information raises questions. I tried calling the number listed for size.com but got a modem or fax machine.

those smell like stolen domains, and trying to pawn them off on ebay doesnt increase my trust of the fellow.

One thing that's consistent is the name servers use of the domain names being sold. Wonder if he tricked NSI into using his name servers.

tonyk2000, that's useful info. Looks like stirlingbirdge.com was a typo of stirlingbridge.com, so all someone had to do was register stirlingbirdge.com to have full control over the domain name.

With the other domains, the original email accounts probably lapsed and were available for registration. There are probably thousands of domain names with at least one contact being an expired hotmail, yahoo, or ISP account that anyone can register.

eBay shows that the same seller had or has these names for auction:

83.com
bottle.com
exw.com
zvi.com
342.com
distribute.com
k4.com
size.com

Do you have similar historical whois data for the other names not listed above?

John, always take care about validity of your e-mails contact addresses!
and you had somewhat good luck - as previous contact info for the domain have been tracked by e-e-e.. honest domainers :) ... so EDG could contact you.

I just wanted to write and communicate that having a reciept for something purchased doesn't always guarantee that legal ownership of property has been transfered.

For example, if I stole a car, then sold it to you, but provided you a reciept, then you in turn sold it to someone else, provided them a reciept, you would still be liable to the party you sold said car to if the rightful owner of the vehicle claimed ownership and took posession of the car.

Unfortunately, if the rightful owner of the domain which you purchased claims his domain back which may have been fradulatently transfered, the purchasing party could sue you for not only the funds paid to you for the property but also could sue for additional damages should a business be set up using said domain and advertising dollars spent marketing it. You then would likely have to go after the person you purchased the un-owned property from to reclaim your funds. Unfortunately you have a legitamate business and likely have some assets. The chain would then continue.

It's a scarey situation. Unfortunately there is no system such as that which is used to transfer property like houses, etc. for domains. One will surely be established at some point in time though.

Wow! it's a scary business. I wonder how many domains were stolen and how many stolen ones I bought.

How can one ensure that the domain is bought from the rightful owner? Does the signed contact help? For example, I bought a domain thru sedo.co.uk. The buyer and I signed the contract. Does that prevent me from liability? If the domain was a stolen domain, does Sedo has liability too?

Nameguy refunded my Paypal transaction for exw.com, so he's shown himself to be honourable in all this.

The name is back at NSI in the hands of that "Alexander Ilin", see WHOIS, and eNom isn't exactly sure how they yanked it back while it was locked.

I'm not an attorney but I can smell a class action suit brewing against NSI for not setting up a system that keeps things legal.

They used to require a notarized document to be sent to them for ownership transfer. I did not know that this had ever changed. If it has, and ownership transfers can be handled without their assistence and they provide the system for doing so and this type of thing happens I'm thinking they may be the liable party but not sure.

So long as they are able to return the property to its rightful owner they should be clear. It's the middle man that could be screwed in my eyes.

Anyone else have any thoughts on this?

John: NSI creates a new creation date for new transfers to them (all of UltSearch's names are like that too). However, the scary part is that it could be yanked back while it was locked, and apparently without eNom's consent.

hmm, a thief being able to yank a domain back to NSI even while it is locked at a different registrar, and without the registrar's permission, is a very unnerving precedent. It certainly lends credence to RacerX's theory that it is someone on the inside at NSI, who is doing the stealing, or assisting with the stealing.

Although direct NSI customers are obliged to submit notarized papers to change ownership, some of their RESELLERS are able to change ownership without such a paper. I have purchased a domain from Namezero once and the ownership was changed on-fly.
