Buying domain name from spouse / estate?

Here's an interesting question for those who have been around awhile...

I had a business associate who owned a very nice domain name registered in his name personally. He passed away last January. I saw his wife at Wal-Mart who asked me if I would like to buy some of his business equipment including his website. I don't have much use for it at the moment, but it's definitely something I might develop someday so I'd be interested in buying it. The domain name is registered in her deceased husband's name and his e-mail address is listed, which has since been closed (MSN). Their personal mailing address is also on the registration (which is still their home).

Here's my question...

If otherwise not named in the estate, is it likely her domain to sell?

Can she ask Netsol to give her access to the domain name? How do you do this?

Anyone had any situation like this before?

she may need an affidavit and/or a death certificate, if she does not have login info to the account where the domain is registered or if she does not have login access to the email address associated with the domain.

If the business is part of the estate, the I believe one could reasonably assume the domain would be included. The point is however, as mentioned already, having or getting the user name and password for the account, which could prove tricky. Does she still have access to his email in order to request the username and password be resent?
