very timely thread for me as well. just received a similar letter, but from a much smaller company. The site in question is c-nbc.com. It's not from the news stations cnbc though, it's for nbc models. It gets quite a bit of type in traffic as well as other sources. I don't really have any plans on developing it as of yet, but if i did, it wouldn't have to do with nbc models, probably cnbc related. any thoughts on this one? by the way, their model site isn't the classiest, more on par with cinemax soft core porn passing for movies.

when sending you that e-mail.

Seems like someone is trying to get away with a free name
by scaring you with empty legal threats.

One thing in your response. was that dreamcast.us was open, why the hell would Sega want to pay $10 for dreamcast.us? Thats just ridiculous, just because different extensions are availabe, doesnt mean a company should be forced to buy every single one just to keep you from getting it illegally.

Yes I know it was a ridiculous response, but it can be attributed to the fact that this was the first time that I have been presented with a situation like this and I had a vague idea of what the best course of action was.

***************Update, Okay I sent them a much more structured letter requesting that I get $75 to pay for my expenses (Thats how much I purchased it for) and that I could have Press Access to some degree. They sent me another letter on the 18th, that totally ignored what I previously said. I decided I didnt want to jump into anything else so here is the letter, and I DIDNT RESPOND YET so I dont make any stupid mistakes.

I have not received any response to my email below. In order to avoid any further violations of Sega's rights, please confirm by December 2, 2002 that your company will comply with the terms of my prior communications, namely, it will transfer the "segagames.com" domain name to Sega (its rightful owner) and agree not to register or use any domain name that incorporates Sega's marks or names in the future.

Please let me know what information you need to facilitate the transfer of the "segagames.com" domain name to Sega.

Well looks like they totally blew me off to a degree except this clause was changed "agree not to register or use any domain name that incorporates Sega's marks or names" to actually make sense. Okay here is what my goals to get out of this are:

If I have to give up the domain: $75, And something that can make up for the lost benefits that the name would have for a fan site. Namely Press access or support from sega in some ways or another.

If I can keep the domain: I am willing to make admissions to Sega such as Not selling it, or somethign along those lines.

I appreciate anymore help people can give me on this matter,

Darfire, I am sorry your issue has not been solved yet.

I know you tried very hard to solve it and how genuine you have been with them. You have shown your good faith IMO.

However, it appears they believe they have all the evidence they need to fight you and perhaps win you at WIPO.

Unofrtunately, this may be one more case of the little guy getting screwed up but you should seriously consider either having an expirienced attorney help you or give it up and move forward.

I wish you the best, I feel for you and hope you keep the name forever man!

Thans for the support, but I realize that I should have been much more cautious when buying this domain, So I quess I sort of brought it down on myself. Well, Still I think that $75 and some Contacts within Sega is not asking much compared to people who shoot for $2,000 an etc.

:), LOL Funny that you should ask. I woke up this morning and got an update from them. They are willing to re-imburse me $75.00, but no press access. All I have to agree to is to transfer the domain. I am going to do it.

What strikes me funny about this is that they claim to be the "rightful owner". They never paid for the domain to begin with so that is phrased very wrong.

Glad you are getting this thing resolved, anyway, it's got to be a headache off of you.

Well, It didnt take up loads of time. But its still time that was uselessly wasted. Well, think of all the time I saved from not putting up a fan site lol.
