If there's no trademark involved...and...

Someone had website-website.com (not the name)

And I took out websitewebsite.com .....same, but no dash....

Could this be infringing ?

Thanks much,

Jerry:

If there is no trademark, there is no infringement. I assume your valid worry is that the other party may initiate some action to force you to stop using the domain name you have chosen, such as by filing a complaint under UDRP. However, in order for the complainant to be successful, they need to show that they have rights in the name and that yours is confusingly similar. This typically necessitates proof of a registered trademark or common law trademark rights in the name. It is always good practice to do a thorough trademark search before you register a domain name.
