Domains from recent TRAFFIC auction

Has anyone managed to get out of their exclusivity agreements for domains put forth at TRAFFIC West?

It seems I'm having no luck getting through to Moniker.

Yeah, sorry if that wasn't clear. This is for domains that didn't sell.
Now I can't market/sell them myself without having to give Monte 15%...until the exclusivity agreement expires, in 60 days.

IF they were presented in the LIVE or SILENT auctions, you are BOUND by the terms of the agreement. So you are "stuck" with it for, what is it? 60 days after the auction?

Anyway... You are in breach if you sell a domain in that case.

If the auction has occured, and the domain was NOT presented live or silent... it is removed from the agreement and you are free to sell without contraint.

Which is actually probably more reasonable than it sounds. A domain selling 60 days after being in the auction may be selling because of the exposure created by being in the auction.

It also prevents bidders (and buyers) from sandbagging at the auction and arranging a "special deal" sometime after.

With respect to the Moniker arrangement -- Agreements can be modified -- and I personally do this alot. It all boils down to terms you are willing to accept (& the other party too) and if they want you're business bad enough, they'll do what it takes to get it, ie modify terms to your liking.

The Moniker agreement automatically renews after 60 days if you dont cancel, this is what Chappy is referring too, you need to contact Moniker and ask them to cancel, I did this and they OK'd my request the same day.
