Ethical question

Starting a new site. Only a few people are doing this and they are doing it poorly and making good money. Great opp for me. Anyway when looking a for name I found that the major players name was available in another form that was better. Say he has zxy, I picked up xyz. Much better name. I'm not going to call my site that, but I do plan on pointing with the name like his.

Should I use the name?
Offer him the name?
build my site, point the name, and keep my mouth shut.
