Farming of Whois data query

There is of course no need for me to say which company collects vast amounts of whois data, but there seems very little said about such collection ,and yet it seems to be against terms & conditions of Verisign and most Registrars . Why does it continue ,and is this a tort in US law ?.

Why does it continue ?
Because nobody took action against it.
