How "dangerous" is it to offer Biz names for sale?

The official Biz rules state that it is forbidden to trade these names just for the profit of it.

What does this mean in practice? Can everybody claim your name just by proving that you're a trader? Or can they still only challenge you with an UDRP procedure where they need a TM?

In theory, yes .biz is for business or for service site use only.

Regarding claiming a domain name from you, they have to submit a challenge to the specific domain via UDRP especially if they own the trademark.

In the early .biz registration, they also allocated a certain time frame to give priorities to trademark owners to protect them from scam buyers of domains .biz. Then it followed by public registration.

Thanks for your info. I'll be a bit more specific with my question. There are/were 3 ways to challenge Biz names. There was the STOP procedure which could only be used during rollout. Then there is the UDRP procedure which requires a trademark.

Now what I am curious about is the so-called RDRP procedure. In this case the claimer only has to prove that you are using the name in a non-business like way, for example by offering it for sale. According to the rules that would be enough to take your name.
Does anyone know how this procedure works in practice? I cannot find any actual cases lsited at WIPO.

To my knowledge, you are allowed to resell .biz domain nams to any third party; however, since this is a restricted TLD (for business use only), others might challenge your ownership if you are not running your .biz for business purposes. An example would be that your are using britney.biz to solely express your craze about Britney Spears (without even selling a Britney Spears poster). They also explicitly state that by putting up a .biz name for sale is not a bona fide business practice and may lead to de-registration. But then you should be allowed to use it for business AND sell it at the same time. Correct me if I'm wrong.

Neulevel put 7,500 .biz names back to the pool after suspicious practices were detected at the registrar level and also at for sale sites.

There was this site that was blatently auctioning over 2,000 biz names. It's all been confiscated and re-released back to the market.

If you look carefully, the same rules apply for .com too. Sell away!
 
Just another reason why .biz names suck for resellers.
 
Perhaps I should make myself clearer: the practice of reselling .biz domain names is not forbidden at all, it's just that when you register a certain .biz domain, you cannot say that your SOLE business or commercial use of the domain is to sell, trade or lease THAT PARTICULAR name.

From my understanding, you could register e.g. sell-trade-lease.biz and use that name for your name-reselling business.

I've pulled all my .biz off my forsale pages and putting up sites with affiliate links,content, banners. If someone wants to buy it from me, they can. But I'm not allowed to offer it for sale, as the sole purpose of owning it.

I agree! It's been over a year since I registered my first .biz. Neulevel has never set forth a certain timeframe before a .biz can be resold. Who can stop you for selling your .biz a year after you purchased it? There could be a lot of reasons for someone selling his domain. That does not mean that he registered the domain in bad faith in the first place. A lot of things can happen in one year...

Could be "seriously ego threatening" if you offer to a dot commer!
 
....glad I came to this thread, I had no idea there was so much legislation about .biz I guess I will have to develop my MotorTrades.biz into a working page......
