.INFO sunrise trademark names (suspect misrepresentation)

I would like to trade/buy a name with a company who still has some of those sunrise tm names that required a mandatory 5 year reg and escaped the Afilias "cleanup".

Is the owner allowed to transfer the ownership of this name over to another party? The TM appears to be inaccurate. I have tried to get Afilias to release the name to no avail. Any clue is much appreciated.
