A trademark can exist simply by continuous commercial use; it does not need to be registered to be protectable.

Ah. However, should there not be official papers citing this? By that definition, I own a trademark that could bring legal action ;)

The purpose of registering a mark is to make it much less prone to disputes. Even a state-registered mark is better than a non-registered, "common law" mark. The ultimate would be a federally registered mark (at the USPTO) and an international mark.
