If you've created a new registration (rather than a transfer) it's *your* domain, theirs ceased to exist when it was suspended, cancelled then deleted as per their registration agreement.

Nasty situation - got it covered, just try to be nice 
Domain expired - they did not renew it - I got it? $100 Min and never more than $200.
I charge them $500 if they have warnings from me to renew that they ignore, you would not belive how many hosts and back-bones ignore to renew their domains! - keeps me in servers
